Listings and Transactions
BookLoop provides a platform for users to buy and sell textbooks. We do not own, sell, or control any items listed on our platform. We are not a party to any transaction between users.
All listings must be for legitimate textbooks that you have the right to sell. Listings must be accurate and not misleading. You agree that you are solely responsible for the content of your listings and for ensuring that your listings do not violate any applicable laws or regulations.
We reserve the right to remove any listing that violates these Terms or that we believe, in our sole discretion, may create liability for us.
Intellectual Property
Our Services and all content and materials included on our Services, such as text, graphics, logos, button icons, images, and software, are the property of BookLoop or our licensors and are protected by South African and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services for their intended purposes subject to these Terms.
Disclaimer of Warranties
Our services are provided “As is” and “As available” without warranty of any kind, either express or implied, including without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that our services will be uninterrupted or error-free, that defects will be corrected, or that our services or the server that makes them available are free of viruses or other harmful components.
Limitation of Liability
In no event shall BookLoop, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (I) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our services, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, or (iv) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our services by any third party.
Indemnification
You agree to defend, indemnify, and hold harmless BookLoop, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to our Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.
Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our platform. Changes will be effective immediately upon posting. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.
Governing Law
These Terms shall be governed by the laws of the Republic of South Africa, without regard to its conflict of law provisions.
